Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Pictoryx platform operated by Pictoryx ("us", "we", or "our"). By accessing or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Pictoryx, you confirm that you are at least 16 years old and agree to these Terms and our Privacy Policy. If you are using Pictoryx on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. Description of Service

Pictoryx provides an AI-powered 3D model generation service that converts product photographs into GLB format 3D assets. The service is provided on a subscription or pay-as-you-go basis as described on our pricing page.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@pictoryx.com of any unauthorized use of your account.

4. Acceptable Use

You agree not to use Pictoryx to:

• Upload images that you do not own or do not have permission to use.
• Generate models of products that infringe third-party intellectual property rights.
• Attempt to reverse-engineer, scrape, or overload our infrastructure.
• Resell or redistribute raw access to our API without written permission.
• Upload unlawful, harmful, or offensive content.

5. Intellectual Property

You retain ownership of the images you upload. You own the 3D models generated from your images and may use them for any commercial or non-commercial purpose. Pictoryx retains ownership of its software, AI models, and platform infrastructure. You grant Pictoryx a limited license to process your uploaded images solely for the purpose of providing the service.

6. Credits and Billing

Paid plans are billed monthly in advance. Credits reset on your billing date and unused credits do not roll over. All fees are non-refundable except as required by law or at our sole discretion. We reserve the right to change pricing with 30 days' notice.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for any loss resulting from scheduled or unscheduled downtime. Generation times are estimates and may vary based on server load.

8. Limitation of Liability

To the maximum extent permitted by law, Pictoryx shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the three months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Pictoryx and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to access the service ceases and your data will be deleted within 30 days.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the updated Terms. We will notify you of material changes via email or an in-app notice.

12. Governing Law

These Terms are governed by the laws of Turkey. Any disputes shall be resolved in the courts of Istanbul, Turkey.
